Analysis of parentage in heterologous assisted reproductive technologies in Peru

In Peru, parentage resulting from heterologous assisted reproductive technologies presents a legal problem
that has not yet been resolved within the current legal framework. Because there is no specific provision in
the Civil Code, legal gaps have arisen that affect the parent-child relationship and the protection of the rights
of children born through these technologies. Regarding the methodology, a basic design was adopted within
a qualitative methodological framework; the design adopted was grounded theory, employing interviews
with family law specialists as research techniques. The results demonstrate consensus among the experts, who consider that the Peruvian legal system lacks specific regulations that recognize reproductive decision-
making as a determining criterion for filiation and the protection of children’s rights.
