The privatization of the public sector: the importance of the expression “public interest” in modern public administration

Resumo
O presente artigo de re exa?o tem como objetivo analisar a forma como o termo “interesse pu?blico” pode ser ou na?o usado como expressa?o de afastamento entre os setores pu?blico e privado, e aprofunda esta problema?tica por interme?dio da ana?lise da querela existente entre valores pu?blicos e privados. A expressa?o “interesse pu?blico” e outras expresso?es conexas sa?o, atualmente, incontorna?veis no contexto da administrac?a?o pu?blica moderna, particularmente quando em causa esta?o temas associados a? privatizac?a?o do setor pu?blico. Trata-se de um feno?meno observa?vel a ni?vel internacional, particularmente intenso nos pai?ses de li?ngua o cial portuguesa e com especial destaque para Portugal. Como conclusa?o, veri ca-se que as semelhanc?as existentes entre os setores e a neutralizac?a?o das suas diferenc?as permitem a rmar que o “inte- resse pu?blico” se mostra, na pra?tica, irrelevante, signi cando pouco mais do que uma mera expressa?o lingui?stica.

Abstract
is re ection paper aims to analyze how the term “public interest” may or may not be used as a distancing expression between the public and private sectors, and deepens this problematic through the analysis of the existing dispute between public and private values. e expression “public interest” and other related expressions are currently unavoidable in the context of modern public administration, particularly when issues associated with the privatization of the public sector are at stake. is phenomenon is observable internationally and is particularly intense in countries of Portuguese o cial language, with particular emphasis on Portugal. As a conclusion we nd that there are similarities between the sectors and the neutralization of their di erences allows us to state that the “public interest” shows, in practice, to be irrelevant, meaning little more than a mere linguistic expression.

Resumen
El presente arti?culo de re exio?n tiene como objetivo analizar la forma como el te?rmino “intere?s pu?blico” puede ser o no usado como expresio?n de alejamiento entre los sectores pu?blico y privado, y profundizar esta problema?tica por intermedio del ana?lisis de la querella existente entre valores pu?blicos y privados . La expresio?n “inte- re?s pu?blico” y otras expresiones conexas son, actualmente, ineludibles en el contexto de la administracio?n pu?blica moderna, particularmente cuando se trata de temas asociados a la privatizacio?n del sector pu?blico. Es un feno?meno observable a nivel internacional, particularmente agudo en los pai?ses donde el portugue?s es la lengua o cial y con especial referencia a Portugal. Como conclusio?n, se observa que las similitudes existentes entre los sectores y la neutralizacio?n de sus diferencias permiten a rmar que el “intere?s pu?blico” se muestra, en la pra?ctica, irrelevante, signi cando poco ma?s que una mera expresio?n lingu?i?stica.
