New lex mercatoria: mutation, soft law and legal security crisis in space transnational negotiation

Abstract

The present article seeks to think about the debate concerning the reappearance or existence of one kind of law called the Lex mercatoria, presenting arguments that demonstrate the existence of the above mentioned law as the expression of a spontaneous, elastic right, mutant, who emerges in the scene of the mercantile negotiation preserving some features of the juridical tradition premodern. This lex mercatoria appears in the frame of a right in crisis guided by the requirements of new protagonists besides juridical agile, flexible instruments that the same time possess an asymmetry and a particular dynamics. For these reasons it thinks that what is in the habit of being named an economic development must go accompanied of an increasing process of a democratization of the spheres and new systems of production of juridical procedure.
