O Trade Dress como ativo de propriedade intelectual: uma visão a partir do pensamento jurídico norte-americano

Introdução: O Trade Dress, entendido como o conjunto de elementos visuais distintivos de um produto ou estabelecimento, é um valioso ativo intangível para as empresas. Não em vão, embora existam diversas vias legais para sua proteção, como direitos autorais, desenhos industriais ou concorrência desleal, estas apresentam limitações significativas em termos de duração e alcance probatório. Objetivo: Analisar, com foco no pensamento jurídico norte-americano, qual é a via de proteção mais eficaz para o Trade Dress. Metodologia: Utilizou-se uma abordagem hermenêutico-sistemática e uma análise documental da doutrina e jurisprudência de bases de dados como Scopus e JSTOR, selecionando a doutrina norte-america-
na por ser pioneira neste campo. Resultados: A análise das diferentes soluções e de casos emblemáticos dos EUA demonstrou que a proteção do Trade Dress, seja
no âmbito da arquitetura ou no design de embalagens, depende dos requisitos de distintividade e não de funcionalidade. Conclusões: A proteção por meio de sinais distintivos, especificamente marcas tridimensionais, apresenta-se como a via mais
eficaz e duradoura. Essa estratégia não apenas protege o investimento empresarial, mas também evita a confusão do consumidor e facilita a construção de uma identidade de marca sólida.
